Introduction
232 Media LLC (“232 Media,” “we,” “us,” or “our”) respects your privacy and seeks to collect and use only the personal information reasonably necessary to operate our websites, communicate with you, provide products and services, and meet our legal and business obligations.
This Privacy Policy explains what personal information we collect, why we collect it, how we use it, the third-party services that may process information on our behalf, and the choices and rights available to you.
This Privacy Policy applies to websites operated by 232 Media LLC, including StellaMSmith.com and AdjustYourLens.com, and to related products and services that link to this Privacy Policy.
232 Media LLC is based in Austin, Texas, United States.
For privacy-related questions or requests, contact us at support@stellamsmith.com.
Information We Collect
The personal information we collect depends upon how you interact with us.
Information You Provide
We may collect information that you voluntarily provide when you:
- submit a Google Form or other form;
- ask a question or request information;
- register for an event, challenge, class, or other offering;
- purchase a product or service;
- communicate with us by email;
- subscribe to publications or email communications; or
- otherwise choose to provide information to us.
Depending upon the interaction, this information may include your name, email address, responses submitted through a form, purchase or transaction information, and information you voluntarily include in communications with us.
Please do not submit sensitive personal information unless it is reasonably necessary for the particular service or interaction.
Purchases and Payment Information
Payments for our products and services may be processed by Stripe or another payment provider identified at checkout.
When Stripe processes a payment, payment-card and other transaction information is provided directly to Stripe. 232 Media LLC does not need to receive or store your complete payment-card number in order to process your purchase.
We may receive information necessary to administer the transaction and deliver your purchase, such as your name, email address, product purchased, amount paid, transaction status, and related transaction records.
Stripe processes information according to its own privacy practices.
Forms and Google Services
We currently use Google Forms for certain registrations, questions, requests, and other information you choose to submit.
Google Forms may be embedded directly into one of our websites. Information submitted through a Google Form is processed using Google’s services and may also be available to 232 Media LLC so that we can respond to your request, provide the service for which you registered, or otherwise fulfill the purpose described on the form.
Some digital products, including the Clarity Cashbook, may also be delivered using Google services. Where a product is provided as a Google file or template, you may be directed to make your own copy within your Google account.
Google’s own privacy practices apply to its processing of information through its services.
Email Publications and Subscriptions
We may use Substack to publish content and offer voluntary email subscriptions.
When you choose to subscribe through Substack, Substack processes information associated with that subscription. Subscribers can manage or unsubscribe from those communications using the controls provided by Substack, including the unsubscribe option provided in emails.
Substack’s own privacy practices also apply to information processed through its platform.
Communications and Product Delivery
We may use the email address you provide to:
- deliver a product or service you requested;
- provide information relating to your purchase or registration;
- respond to a question or request;
- provide necessary administrative or service communications; or
- send marketing or publication emails where you have chosen to receive them.
Transactional or service-related communications are different from optional marketing communications and may be necessary to fulfill a purchase or request.
Why We Use Personal Information
Depending upon the circumstances and applicable law, we process personal information for purposes including:
- providing products or services you request;
- processing and administering purchases;
- delivering digital products;
- responding to questions and communications;
- administering registrations and events;
- maintaining business and transaction records;
- operating, maintaining, and securing our websites;
- preventing fraud, misuse, or security problems;
- complying with accounting, tax, legal, and regulatory obligations; and
- sending optional publications or marketing communications when appropriate.
For individuals protected by the General Data Protection Regulation (“GDPR”) or similar laws, our legal basis for processing depends upon the particular activity.
We may process information:
To perform a contract or take steps at your request. This includes processing information necessary to fulfill purchases, deliver products or services, and administer registrations you request.
With your consent. This may include optional email subscriptions or other processing for which we specifically ask for consent. Where processing is based upon consent, you may withdraw that consent at any time.
For our legitimate interests. We may process information as reasonably necessary to operate and secure our websites and business, respond to communications, maintain appropriate business records, and improve our services, provided those interests are not overridden by your applicable privacy rights.
To comply with legal obligations. We may retain or process information where necessary to comply with applicable tax, accounting, legal, regulatory, fraud-prevention, or other obligations.
Third-Party Service Providers
We use a limited number of third-party services to operate our websites and provide our products and services.
These currently include services such as:
- Namecheap for website hosting and related infrastructure;
- WordPress as our website publishing platform;
- Google services, including Google Forms and Google Drive or related Google applications, for forms, registrations, communications, and digital product delivery;
- Stripe for payment processing; and
- Substack for publications and voluntary email subscriptions.
These providers may process personal information as necessary to provide their services. Their processing may also be governed by their own privacy policies and terms.
We do not sell our email list.
We do not currently use advertising pixels or behavioral retargeting technologies on our websites.
Cookies and Similar Technologies
Our websites and the services embedded within them may use cookies or similar technologies that are necessary to provide website functionality, security, embedded content, or requested services.
For example, a Google Form embedded on one of our websites is provided through Google’s systems and may communicate with Google when the embedded service is loaded or used.
We do not currently use Google Analytics, Meta/Facebook Pixel, or other advertising pixels for behavioral advertising or retargeting on our websites.
Browser settings generally allow you to control, restrict, or delete cookies. Restricting technologies that are necessary for a particular third-party feature may affect your ability to use that feature.
If we later add analytics, advertising, or other non-essential tracking technologies that require consent under applicable law, we will update our practices and provide appropriate choices where required.
Sharing Personal Information
We may disclose personal information:
- to service providers that help us operate our business or provide requested products and services;
- when necessary to complete or administer a transaction;
- when you direct or authorize us to do so;
- when required by applicable law, regulation, subpoena, court order, or other valid legal process;
- when reasonably necessary to protect our rights, users, property, systems, or security; or
- in connection with a business reorganization, merger, sale, or transfer, subject to applicable legal requirements.
232 Media LLC does not sell personal information for money.
We also do not use personal information collected through our websites to create behavioral advertising or retargeting audiences.
International Data Transfers
232 Media LLC is located in the United States, and the third-party services we use may process or store information in the United States or other countries.
If you access our websites or services from the European Economic Area (“EEA”), United Kingdom, Switzerland, or another jurisdiction with data-transfer requirements, your personal information may therefore be transferred to and processed in a country other than your own.
Where applicable law requires safeguards for international transfers, we and/or the relevant service providers rely upon legally recognized transfer mechanisms or safeguards as applicable to the particular processing.
How Long We Keep Information
We retain personal information only for as long as reasonably necessary for the purpose for which it was collected and for legitimate business or legal requirements.
Retention periods may vary depending upon the type of information. For example, transaction and accounting records may need to be retained for tax, accounting, fraud-prevention, or legal purposes even after a customer relationship ends.
Information submitted for a particular inquiry or registration may be deleted when it is no longer reasonably necessary, subject to legitimate business and legal requirements.
Where information is processed directly through a third-party platform, that provider may maintain its own retention practices.
Security
We take commercially reasonable administrative and technical measures appropriate to the nature of the information we handle.
We also rely upon established third-party providers for services such as website hosting, forms, digital-file delivery, email publishing, and payment processing.
No method of transmitting or storing information electronically can be guaranteed to be completely secure, and we cannot promise absolute security.
Your Privacy Rights
Depending upon where you live and the law that applies to you, you may have rights concerning your personal information.
These may include the right to:
- request access to personal information we hold about you;
- request correction of inaccurate personal information;
- request deletion of your personal information in circumstances provided by law;
- request restriction of certain processing;
- object to certain processing, including certain direct marketing;
- request portability of information where applicable;
- withdraw consent at any time where our processing is based upon your consent; and
- lodge a complaint with an applicable data-protection or supervisory authority.
These rights are not absolute and may be subject to exceptions or limitations under applicable law. For example, we may be legally required to retain certain transaction records even after receiving a deletion request.
To make a privacy request concerning information controlled by 232 Media LLC, email support@stellamsmith.com.
We will respond within the timeframe required by applicable law and may need to verify your identity before fulfilling certain requests.
If information is controlled directly by a third-party service such as Google, Stripe, or Substack, you may also need to exercise your rights directly with that provider.
Email Choices
You may unsubscribe from optional marketing or publication emails using the unsubscribe link provided in those emails or the subscription controls provided by the applicable service.
Unsubscribing from optional marketing communications does not necessarily prevent us from sending communications that are reasonably necessary to fulfill a transaction, deliver a product, respond to your request, or provide important information about a service you requested.
Children’s Privacy
Our websites and services are not directed to children under 13, and we do not knowingly seek to collect personal information directly from children under 13 through our websites.
If you believe a child has provided personal information to us inappropriately, please contact support@stellamsmith.com.
Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our services, technology, privacy practices, or applicable law.
When we update this policy, we will revise the “Last Updated” date above. If applicable law requires additional notice or consent for a material change, we will provide it as required.
